1. Purpose of this policy
This Anti-Circumvention Policy aims to protect the integrity of the ВПУТИ ТЕХНОЛОГИИ platform and to prevent users from intentionally bypassing the platform's services, commissions, service fees, or other charges.
By using the platform, every user agrees to this policy.
2. Scope
This policy applies to all users of ВПУТИ ТЕХНОЛОГИИ, including but not limited to:
- individuals
- companies
- self-employed persons
- employers
- clients
- job seekers
- freelancers
- service providers
- suppliers
- lessors
- rental companies
- restaurants
- hotels
- transporters
- couriers
- real estate agents
- contractors
- recruiters
- employment agencies
- other business users
3. Prohibition on circumvention
Users may not intentionally circumvent the platform's operations for the purpose of avoiding platform fees, commissions, subscriptions, service charges, or other amounts due. Circumvention includes, among other things:
- concluding an agreement outside the platform after the parties have been introduced to each other via ВПУТИ ТЕХНОЛОГИИ
- exchanging phone numbers, email addresses, websites, or other contact details for the purpose of conducting future transactions outside the platform
- using third parties or intermediaries to avoid platform fees
- creating multiple accounts to bypass restrictions or fees
- providing incorrect or misleading information to circumvent checks
- offering or accepting payments outside the platform where the platform mandates payment via the platform for the service in question
- any other action aimed at circumventing the rights or fees of ВПУТИ ТЕХНОЛОГИИ
4. Automated monitoring
To protect the platform, ВПУТИ ТЕХНОЛОГИИ may carry out automated checks, including:
- detection of phone numbers
- detection of email addresses
- detection of websites
- detection of social media accounts
- detection of QR codes
- detection of payment requests
- detection of unusual communication patterns
- AI-driven fraud detection
- logging of relevant system activities
To the extent permitted by law, messages or data may be automatically masked or blocked if a potential violation is detected.
5. Measures in the event of a violation
If ВПУТИ ТЕХНОЛОГИИ suspects a violation, the platform may take measures including, but not limited to:
- issuing a warning
- temporarily restricting communication
- removing advertisements or assignments
- requiring re-verification
- temporarily blocking an account
- permanently terminating an account
- revoking Premium features
- temporarily suspending payouts to the extent permitted by law
- conducting further investigation
- taking legal action if necessary
6. Contractual penalty
If it is determined that a user has intentionally bypassed the platform in violation of the agreed platform terms, ВПУТИ ТЕХНОЛОГИИ may, to the extent permitted by applicable law, impose a contractual penalty of 500,000 (five hundred thousand) Russian rubles per violation.
If the actual damages incurred exceed the amount of the contractual penalty, ВПУТИ ТЕХНОЛОГИИ reserves the right, to the extent permitted by law, to claim additional compensation. The ultimate enforceability of a contractual penalty depends on applicable law, the terms of the agreement, and the assessment by the competent court.
7. Collection
If a user fails to satisfy a due contractual penalty or other payment obligation within the agreed payment period, ВПУТИ ТЕХНОЛОГИИ reserves the right to:
- transfer the claim to a lawyer or authorized debt collection partner
- claim statutory interest, where permitted
- recover reasonable extrajudicial collection costs, to the extent permitted by law
- claim court costs and litigation expenses, where permitted by law
- submit the matter to the competent court to demand fulfillment of the payment obligation, the contractual penalty, and any additional compensation
8. Exclusion of liability
ВПУТИ ТЕХНОЛОГИИ reserves the right to take appropriate measures to protect the platform and its users, but does not guarantee that every violation or attempted circumvention can be prevented or detected.
9. Amendments
ВПУТИ ТЕХНОЛОГИИ may amend this Anti-Circumvention Policy at any time. The most recent version will be published.
